Can You Bring a Blogger to your Examination for Discovery?

The Ontario Superior Court of Justice just ruled that the open court principle does not apply to out of court proceedings such as a cross examination on an affidavit or an examination for discovery in the most recent motion of St. Lewis v. Rancourt.

Ont SCJ Dismisses Application in Sierra Club Canada v. Ontario

The Ontario Superior Court of Justice has dismissed the application for judicial review in Sierra Club Canada v. Ontario.

In doing so, they refused to determine whether the evidence put before the Minister of Natural Resources, Linda Jeffrey, was sufficient in determining the threat to Species at Risk (SARs) from the construction of an additional crossing at Windsor-Detroit.  The court also rejected the argument that the precautionary principle used extensively in environmental law was an overarching consideration that must be adhered to when considering competing interests.

2011 Opening of the Courts

The 2011 Opening of the Courts service was held at the Church of the Holy Trinity.  

Protesters attended, raising grievances with the family law system.

Remarks by Chief Justices Heather Smith , AnneMarie Bonkalo, and Warren Winkler both raised calls for reform of the family justice system.

An advance screening of a documentary, Blakout, also criticizing the family justice system occurred at The Royal Cinema on September 15, 2011.

Tips and Tricks from the Trade

The Association for Chinese Canadian Lawyers in Ontario (ACCLO) hosted a CLE session this weekend on “Tips and Tricks from the Trade,” featuring Sean Zhang of Blakes on intellectual property law, Jeffrey Lem of Davies on real estate law, Roslyn Tsao of Epstein Cole LLP on family law, and Madam Justice W. Low of the Ontario Superior Court of Justice on general tips from the bench.

David J. Bilinksy on Why You Should Stay in Law School


David J. Bilinsky provides some advice to law students and mentions the importance of blogging for creating a profile,

Target the law that you wish to do and then start to find firms that practice that area..and try to get on their radar screen. How? Use social media!  The best way I know of is to start working in that area – by building a blog and start getting known for your interest in a certain area.  Omar Ha-Redeye was a law student in Canada that started a blog as a student on health and reputation management law (he is now a called lawyer) and this blog gave him immense exposure well before he graduated and led to his being included in award-winning legal blogs as www.slaw.ca.  You can see Omar’s blog here.

A drive-by shooting may not be considered an accident under the Statutory Accidents Benefits Schedule, but an attempted carjacking was in Downer v. Personal Insurance.

When Anonymous Posters Sue Anonymous Posters

When the law suit against Law Buzz named Russell Howe, Tycho Manson, Kevin Preston, and Jenny Rutherford as defendants, the last thing anybody expected was that these defendants would start their own law suit to identify other anonymous posters.

Tycho Manson launched a lawsuit against a Blogspot site, Law Buzz Litigation, to identify anonymous posters there allegedly defaming him.  Manson was recently successful at the Ontario Superior Court of Justice in receiving an order that should provide him this information.
